"Coming out of the German tradition in which rights of representation and appearance before appeals chambers and higher courts were restrictively bestowed on selected legal practitioners, I have dealt with civil proceedings at the instance of appeal for over 30 years. Dealing with proceedings at the second instance makes it possible to anlyse the facts without bias and look at them from a fundamentally new perspective. This often allows for the focus to be shifted to factual or legal aspects which may serve to influence the further course of the legal dispute favourably. Further adversary proceedings do, however, not always make sense, financially speaking. This is particularly evident in extensive construction proceedings. Here, out-of-court dispute resolution in the form of mediation, arbitration proceedings or the practice of cooperative procedures are appropriate alternatives available. Dr. Petra Christiansen-Geiss is a trained mediator (DAA). She specialises in particular in proceedings at courts of second instance, especially in the areas of architecture and engineering law, in private construction law, in liability and insurance law as well as real property law. A further focus of her work lies in mediation and conflict management as well as assisting an advising clients in out-of-court dispute resolution.
